ProMechBC and its associates strive to provide accurate product descriptions. However, we do not warrant that product descriptions or other content on this site are always accurate, complete, reliable, current, or error-free. If a product offered by ProMechBC is not as described, your sole remedy is to return it in unused condition.

Site Policies, Modification and Severability:

We reserve the right to make changes to our site, policies, and these Conditions of Use at any time. If any of these conditions are deemed invalid, void, or unenforceable for any reason, that condition will be considered severable and will not affect the validity and enforceability of the remaining conditions.

Delay:

In the event of any delay by ProMechBC in commencing, executing, or completing the Services, not caused by the client or by a force majeure event, no claim for additional payment or any extension of time will be considered.

Disclaimer:

The following legal terms, conditions, and notices apply to all services, repairs, tune-ups, sales, and rentals, including but not limited to electric scooters, bikes, electric bikes, mopeds, regardless of the brand, model, make, purchase, and whether serviced and/or rented from ProMechBC Inc. By signing our Terms and Conditions and Liability Waiver & Release, you acknowledge the essential risks and dangers associated with using an EV such as an electric bike, electric scooter, moped, etc. ProMechBC Inc. is not liable for problems or damage caused by accidents, failure to follow instructions, careless actions, incorrect installation, mechanical or electrical failures, which may result in personal injury, malfunction, loss of use, business interruption, fire incidents, punitive or special damages, disability, serious physical injury, illness, or death. Our sole responsibility and liability related to a defective component, service errors, or faulty installations are limited to waiving service charges paid by the Client to the Service Provider. Under no circumstances will ProMechBC Inc. be liable for further damages, fees, or penalties.

Limitation of Liability:

By signing the terms and conditions, you acknowledge that you have had adequate time to review the Liability Waiver & Release and to ask any questions before signing this agreement. You also agree to all the terms and conditions and have willingly chosen to use our services, such as repair, installation, battery refurbishing, tune-ups, and diagnostic tests by ProMechBC Inc. You understand that you are solely responsible for your health and safety and cannot take legal action against ProMechBC Inc., including its directors, officers, agents, employees, subsidiaries, and affiliates, for any damages or penalties. In the event of the signer’s death or disability, the terms of this Liability Waiver & Release, including indemnification responsibilities, will apply to the signer’s estate, and their personal representatives, executors, and administrators will be bound by them. The undersigned signer certifies that they have fully informed themselves about this Terms & Conditions and Liability Waiver & Release, including its consequences, and have signed it of their own free will.

Indemnity:

Unless prohibited by law, by signing the terms and conditions, you indemnify and hold ProMechBC, along with its directors, officers, agents, employees, subsidiaries, and affiliates, harmless from any actions, claims, losses, damages, liabilities, and expenses, including legal fees.

ProMechBC Inc. will not be liable for any damages of any kind arising from the use of any ProMechBC Inc. services, or from any information, content, diagnostic reports, materials, products, or other services included on or otherwise made available to you through any ProMechBC service centers or service providers, including but not limited to direct, indirect, incidental, punitive, and consequential damages.

 

Return &Refund

We have a 7-day return policy, which means you have 7 days after receiving your item to request a return. To be eligible for a return, your item must be in brand new condition, unworn or unused, and in its original packaging. You will also need the receipt or proof of purchase. To start a return, contact us at info@promechbc.com . Returns must be sent to the following address: 120-1868 Glen Drive, Vancouver, BC V6A 4K4. In your email, include your full name, order number, reason for return, and pictures of the issue.

Product shall be unused, undamaged, unscratched, clean in the original package and resell-able to be eligible for a return and refund. A 20% handling and re-stocking fee will apply to all eligible in store and online order returns. Packing and shipping expenses (including free-shipping deals) are not refundable. If your return is accepted, You can ship it to the address mentioned in the email and after inspection and confirming the product is in new condition, the refund on the unit will be done. NOTE: Shipping must be covered by clients and Company does not cover the shipping charges for any return unless the parts are defective. The refund on the parts that were purchased will be done between 5-10 business days and it will automatically be deposited back to your account.

Items sent back to us without first requesting a return will not be accepted. You can always contact us for any return question at  info@promechbc.com

Damages and issues: Please inspect your order upon reception and contact us immediately if the item is defective, damaged or if you receive the wrong item, so that we can evaluate the issue and make it right for you.

Exceptions / non-returnable items:

If the product is used or more than 7 days, the product can not be returned for refund. Certain types of items cannot be returned. We also do not accept returns for hazardous materials, flammable liquids, or gases. Please get in touch if you have questions or concerns about your specific item.

Exchanges The fastest way to ensure you get what you want is to return the item you have, and once the return is accepted, make a separate purchase for the new item and only cover the shipping charges. In some cases the company may agree to cover partial shipping charges if you are doing an exchange.

Refunds We will notify you once we’ve received and inspected your return, and let you know if the refund was approved or not. If approved, you’ll be automatically refunded on your original payment method within 10 business days. Please remember it can take some time for your bank or credit card company to process and post the refund too. If more than 15 business days have passed since we’ve approved your return, please contact us at info@promechbc.com and our team will assist you right away.
